1. ACCEPTANCE OF TERMS

These Terms of Service ("Terms") govern your access to and use of the website https://bloomvillekids.com ("Site") and the purchase of any products offered through the Site. The Site is operated by:

(hereinafter "Bloomville Kids," "we," "us," or "our").

By accessing the Site or placing an order, you ("Customer," "you," or "your") agree to be bound by these Terms, our Privacy Policy, Return & Refund Policy, and Shipping Policy. If you do not agree, do not use the Site and do not place an order.

2. ELIGIBILITY

You must be at least 18 years of age and legally capable of entering into a binding contract to purchase products from Bloomville Kids. Our products are intended for purchase by adults (parents, guardians, and gift-givers) for use by or for children. By placing an order, you represent that you meet these requirements.

3. PRODUCT INFORMATION AND ACCURACY

Bloomville Kids makes commercially reasonable efforts to display accurate product descriptions, images, materials, sizing, age recommendations, and pricing. However, we do not warrant that product descriptions, colors, or other content are accurate, complete, reliable, current, or error-free. Product appearance may vary slightly from images due to lighting, screen calibration, and minor batch variations.

We reserve the right to correct any errors, inaccuracies, or omissions, and to change or update information at any time without prior notice (including after you have placed an order).

4. ORDERS AND ACCEPTANCE

Placement of an order constitutes an offer to purchase. We reserve the right to accept or decline any order at our sole discretion, including in cases of suspected fraud, inaccurate customer information, product unavailability, pricing errors, or suspected violation of these Terms.

An order is not accepted until we send a shipping confirmation email. We are not obligated to fulfill orders containing pricing errors, even if payment has been processed; in such cases, we will issue a full refund.

5. PRICING AND PAYMENT

All prices are listed in U.S. Dollars (USD). Prices are subject to change without notice.

⚠️ All applicable U.S. import duties and customs charges are prepaid by us through our shipping arrangement (Delivered Duty Paid). You will not be charged any additional customs, duties, tariffs, or carrier handling fees at delivery. The price shown at checkout is the full price you pay.

Applicable U.S. state sales tax (where required by law) will be calculated and displayed at checkout.

We accept the following payment methods:

Payment is processed at the time of order placement.

6. SHIPPING

Products are shipped directly from our supplier's warehouse in the People's Republic of China to customers in the United States. Estimated delivery time is 10 to 21 business days from dispatch. Full shipping terms, including our Delivered Duty Paid arrangement, are set forth in our Shipping Policy.

7. CHILDREN'S PRODUCT SAFETY AND COMPLIANCE

Bloomville Kids takes the safety of children's products seriously.

a) TOYS
Toys sold on this Site are intended to comply with the U.S. Consumer Product Safety Improvement Act (CPSIA) and ASTM F963, the mandatory U.S. toy safety standard. For toy products, we maintain Children's Product Certificates (CPC) and third-party test reports from CPSC-accepted laboratories, and toys carry tracking labels as required by law.

b) AGE GRADING AND CHOKING HAZARDS
⚠️ Each toy product page states the manufacturer's recommended age range. Many toys are not suitable for children under 3 years of age due to small parts that may present a choking hazard. Please read all age recommendations and warnings on the product page and product packaging before purchase and before allowing a child to use the product.

c) CHILDREN'S APPAREL
Children's apparel sold on this Site is intended to comply with applicable U.S. safety standards, including drawstring safety requirements for children's upper outerwear (16 CFR Part 1120 / ASTM F1816).

d) PARENTAL SUPERVISION
All children's products are intended to be used under appropriate adult supervision. Customers are responsible for selecting products appropriate to the age and developmental stage of the child, for reading all safety warnings, and for supervising the child's use of the product.

8. CALIFORNIA PROPOSITION 65 NOTICE

This warning is provided as a precautionary measure and does not necessarily mean that any specific product exceeds the warning threshold.

9. INTELLECTUAL PROPERTY

All content on the Site — including text, graphics, logos, images, videos, product designs, and the Bloomville Kids brand — is the property of Starc Ecom B.V. or its licensors and is protected under U.S., Dutch, European, and international intellectual property laws.

You may not copy, reproduce, distribute, modify, transmit, display, publish, sell, license, or create derivative works from any content on the Site without our prior written consent.

10. PROHIBITED USES

You may not use the Site to: violate any applicable law; infringe any third party's rights; submit false or fraudulent information; interfere with or disrupt the Site (including viruses, scraping, or automated access); resell or commercially exploit products without our written consent; or impersonate any person or entity.

We reserve the right to terminate access, cancel orders, and pursue legal remedies for violations.

11. RETURNS AND REFUNDS

Returns and refunds are governed by our Return & Refund Policy. For hygiene reasons, certain products may not be eligible for return once opened or used.

12. DISCLAIMERS AND LIMITATION OF WARRANTIES

EXCEPT AS EXPRESSLY STATED IN THESE TERMS AND EXCEPT FOR RIGHTS THAT CANNOT BE EXCLUDED UNDER APPLICABLE LAW, THE SITE AND PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE."

To the fullest extent permitted by applicable law, we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement, except where such disclaimer is prohibited by law.

Nothing in these Terms excludes or limits the statutory conformity rights of consumers under applicable law.

13. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law:

a) We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, loss of data, or business interruption, arising out of or relating to these Terms, the Site, or any product;

b) Our aggregate liability for any claim arising out of an ordinary commercial dispute (such as a pricing, shipping, or refund dispute) shall not exceed the total amount you paid for the product giving rise to the claim;

c) ⚠️ IMPORTANT — NOTHING IN THESE TERMS LIMITS OR EXCLUDES OUR LIABILITY FOR: (i) death or personal injury caused by our negligence or by a defective product; (ii) liability under applicable product liability law, including the EU Product Liability Directive (85/374/EEC) and applicable U.S. state product liability law; (iii) fraud or fraudulent misrepresentation; or (iv) any other liability that cannot be excluded or limited under applicable law.

The limitation in subsection (b) does not apply to claims for personal injury, which are governed by mandatory product liability law.

14. INDEMNIFICATION

You agree to indemnify and hold harmless Bloomville Kids, Starc Ecom B.V., and their respective officers, employees, agents, and suppliers from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of your breach of these Terms, your misuse of a product, your failure to supervise a child's use of a product, or your violation of any law or third-party right. This indemnification does not apply to claims arising from a defective product or our own negligence.

15. GOVERNING LAW AND JURISDICTION

These Terms and any dispute arising out of or relating to them, the Site, or any product are governed by the laws of the Netherlands, without regard to conflict of laws principles.

Any dispute shall be brought exclusively before the competent courts of Amsterdam, the Netherlands.

This Section does not affect any mandatory consumer protection rights that may apply in your state of residence and that cannot be waived by contract.

16. THIRD-PARTY LINKS

The Site may contain links to third-party websites. We are not responsible for the content, privacy practices, or availability of any third-party site. Use is at your own risk.

17. MODIFICATIONS TO TERMS

We reserve the right to modify these Terms at any time. Changes are effective when posted with an updated "Last updated" date. Your continued use of the Site constitutes acceptance of the modified Terms.

18. SEVERABILITY

If any provision is held invalid or unenforceable, the remaining provisions continue in full force, and the invalid provision is modified to the minimum extent necessary to make it enforceable.

19. ENTIRE AGREEMENT

These Terms, together with the Privacy Policy, Return & Refund Policy, and Shipping Policy, constitute the entire agreement between you and Bloomville Kids regarding your use of the Site.
